Below you’ll find our Terms of Service and Privacy Policy, which outline how we handle orders, shipping, warranties, and data. It’s the fine print that helps protect both of us, so you can order with confidence knowing exactly what to expect.

Terms of service.

Welcome to Gore Design Co., LLC and Hard Goods LLC (“GDCo.,” “we,” “us,” or “our”). By placing an order with us, whether through our website, by phone, or directly, you agree to the following Terms of Service and Privacy Policy. Please read carefully.

1. Orders & Confirmation

A project is considered “confirmed” once we receive both a signed invoice and a deposit. Lead time begins only after client approval of shop drawings and material samples (if applicable). Delays in confirmation or approval may result in a delay of your project.

2. Pricing & Payment Terms

  • Deposit: A 50% non-refundable deposit is required to reserve a production slot.

  • Final Payment: Remaining balance, including change orders, crating, freight, and insurance, is due upon project completion and must be paid before shipment or delivery.

  • Payment Methods: We accept check, bank transfer, money orders, wire, PayPal, Zelle, Venmo, Cash App, and Visa/MasterCard. Credit card and PayPal payments include a 3.75% processing fee. No fees are charged for incoming wires, but if your bank charges one, that fee will be invoiced.

  • Due Date: Final payment must be made within 14 days of the final invoice. Late payments are subject to daily storage fees of $35 per crate and interest at the maximum rate allowed by law.

  • Freight: Freight and crating charges are estimates only. Actual charges will be invoiced and must be paid in full prior to release of shipment.

3. Freight, Delivery & Risk of Loss

  • For domestic freight, GDCo. will assist in booking but all shipments become the client’s responsibility upon delivery to the carrier.

  • For international orders, clients must book and manage their own freight and customs clearance. We provide crating and load the truck, but liability transfers once it leaves our facility.

  • Clients must inspect deliveries upon arrival. Any damage must be documented on the Bill of Lading and photographed before the driver leaves. Failure to do so constitutes full acceptance of the product.

4. Shop Drawings & Revisions

Our quote includes one (1) shop drawing and one (1) revision. Additional revisions will be billed at $250 per hour.

5. Changes & Cancellations

  • Change orders must be agreed to in writing and paid upon signing.

  • Orders may not be canceled after confirmation. Deposits are non-refundable, as a production slot has been reserved and opportunity costs are incurred.

6. Warranty

We warrant our workmanship and materials against manufacturing defects for one (1) year from delivery. Warranty is non-transferable. Exclusions include:

  • Misuse, neglect, accidents, or abuse.

  • Improper cleaning (e.g., abrasive cleaners, acids, solvents, citrus cleaners, acetone, paint removers).

  • Third-party modifications or alterations.

  • Natural variations in color, air pockets, and surface texture.

  • Patina and aging, which are considered features, not flaws.

Remedies: At our discretion, we may refund, repair, refinish, or replace. Notice of defects must be made in writing within 10 days of discovery.

7. Care & Maintenance

  • Avoid placing objects on surfaces for extended periods during the first six weeks.

  • Do not use tape, abrasive cleaners, or solvents.

  • Use only pH-neutral cleaners (e.g., Windex with Vinegar, Simple Green).

  • Reapply sealer every 3–5 years for indoor use, annually for outdoor use, using ICT Reactive Sealer (available from Kodiak Pro).

8. Delays

We are not responsible for delays outside our control, including weather, supply chain issues, labor shortages, government actions, or acts of God. We will resume work as soon as conditions permit.

9. Marketing Rights

Clients grant GDCo. the right to photograph and film completed projects for use in marketing, advertising, and promotional materials.

10. Termination

If the Client terminates the agreement, no portion of the deposit will be refunded. Termination must be made in writing via email or certified mail.

11. Legal Terms

  • Governing Law: These Terms are governed by the laws of Kansas.

  • Venue: Any disputes will be resolved in Sedgwick County, Kansas.

  • Collections: Client agrees to pay all collection costs, including attorney and court fees. Returned checks are subject to a $50 fee.

  • Severability: If one provision is found invalid, the rest remain enforceable.

  • Waiver: Failure to enforce a provision does not waive future rights.

  • Indemnification: Each party agrees to indemnify and hold harmless the other from claims arising from their own actions or omissions.
